BTS PORT DOUGLAS PTY LTD:

15% cancellation fee is applied for all tours cancelled with more than 48hrs notice of tour departure. 50% cancellation fee is applied for tours cancelled between 12 and 24hrs prior to departure. No refund for no shows or less than 12 hours notice of cancellation. Full refund provided if tour or transfer is cancelled by operator.

Down Under Cruise & Dive:

All monies forfeited unless we are notified 48 hours prior to departure. For passengers voluntarily leaving the vessel or withdrawing from a course after day one, there will be no refund. Cancellation of a dive course is fully refundable up until the end of day 1 only. Excluding deposit if paid. All Tours are subject to the effect of weather or unforeseen circumstances. All dives are weather permitting and operate at the Captains discretion. No refund for incomplete dives. Should a cruise not operate for any such reason passengers will be offered an alternative day or refund for days lost only. The operator reserves the right to cancel any tour, change vehicle type or arrange an alternative carrier if the minimum numbers in a group is not sufficient. A reef tax applies to all persons traveling to the Great Barrier Reef. This will be $20 and payable onboard. Please be aware that snorkelling and diving may be a strenuous activity. All divers must complete a medical questionnaire on board. Some existing medical conditions and / or the taking of certain medication may exclude the individual from in-water activities. Please discuss existing medical conditions with staff prior to travel. Divers 65 yrs and over must provide a current AS4005-1 dive medical prior to travel. Certified divers must show an internationally recognised scuba cert card. In the interest of safety we recommend that you do not fly within 24hrs of last dive. Please consider wind strength or roughness of sea before booking. All trips/dives are weather permitting at captains /divers discretion. No refund for incompleted dives. No refund for passengers voluntarily leaving any vessel early. All monies forfeited if cancelling less than 48hrs prior to travel. Should a trip be cancelled, passengers may be offered an alternative day for lost time/trip.

Cairns Dive Centre:

Cancellations or changes to bookings within 48hrs of departure for any reason will not be entitled to any refund. 20% Cancellation fee on all bookings regardless of date.

Swan Valley Tours:

Swan Valley Tours reserve the right to cancel tours due to insufficient passenger numbers. Swan Valley Tours shall not be liable for any injuries, illness, damage, loss or delay that may be caused to the passenger and/or their belongings whilst on tour. Full payment or credit card details are required to confirm a booking. Cancellation fee is 100% within 24 hours.

Captain Cook Cruises:

All cancellations are subject to an AUD$50.00 administration fee per person. Cancellation requests must be made in writing, and we strongly suggest the use of registered mail or fax. Cancellations received inside 60 days of sailing will be subject to cancellation charges at the following rates: 30-59 days; AUD$200.00 pp deposit. within 15-29 days; 50% of fare. 14 days or less; 100% of fare. no-shows at sailing; 100% of fare. Cancellation fees, less the administration fee may be applied to another cruise if completed within 12 months of original booking.

Sydney HeliTours:

Cancellation 24-48 hours before the flight incurs a 50% cancellation fee. If cancelled within 24 hrs of the flight, there is a 100% cancellation fee. If passengers elect not to fly due to weather, but the helicopter flight is still operational, a 100% cancellation fee applies.

Rhythmboat Cruises Sydney Harbour :

Please note that once booked and paid for, 100% cancellation fees apply.

Sunrover Tours:

Cancellations received with less than 2 weeks notice, will incur a 50% cancellation fee. If you cancel your tour with less than 48hrs notice then a fee of 100% may be applied. No Show (failure to collect tour tickets) / We fulfill our commitment to you for the sale of the tour ticket to you by making the tour ticket available at the pick up point for you to collect. If for any reason you are unable to collect all or part of your tour tickets purchased from us we are unable to refund your purchase. If the tour is cancelled because of an act of war or terrorism or the forces of nature or by any event outside of the control of the tour operator then refunds shall be at the tour operator’s absolute discretion. If the tour is cancelled for any other reason, we will refund to you the tour ticket price exclusive of all booking and delivery fees. We do not refund the booking or delivery fee because we have provided you with the service you paid for- the booking and delivery of the tour ticket has been completed.

Australian Day Tours:

DAY TOURS · Tours cancelled within 48 hours will incur a 50% fee. · If cancelled within 24hrs of travel or passengers Fail to Load 100% cancellation fee applies. . Concession Fares - Valid for Australian and New Zealand Pension and Senior Card Holders. ACCOMMODATED/OVERNIGHT TOURS · A $150 cancellation fee applies for accommodated tours cancelled 3 days or more prior to departure. · Accommodated Tours cancelled within 3 days of departure will incur a 50% cancellation fee. · 100% cancellation fee applies if cancelled within 24hrs of departure or if passengers fail to load.

Frankland Island Cruises:

A 100% cancellation fee applies if advice is not provided a minimum of 36 hours prior to departure for cancellations or amendments.

Cairns Adventure Group:

50% Refund within 48 hours no refund if within 24 hours of departure

HARTLEYS CROCODILE ADVENTURES:

Cancellation Policy Packages with transfers, meals or personalised wildlife experiences: Outside of 24 hours - no charge. 12 - 24 hours before arrival - 50% charge. Less than 12 hours before arrival - 100% cancellation fee applies.

Vagabond Cruises:

Minimum 14 days notice is required for a full refund to apply, there's no refunds for cancellations after this period, change of mind or no shows on the day of the cruise. Important: Please ensure that all members of your party have been made aware of the following conditions. These Terms and Conditions apply to the transaction detailed on this documentation. Your acceptance of these conditions is a term of supply of the Services. By paying for and accepting supply of the Service, you agree to be bound by these conditions. 1. Definitions: Service refers specifically to the hot air ballooning mentioned on this documentation and generally to the range of products provided by the tour operator, including accommodation and customised activities arranged by agreement. Service Operator refers to the tour company named on your confirmation or any independent contractor supplying/delivering the services to you under the your Agreement with the tour operator. 2. Liability Under no circumstances will The Tour Operator be liable for direct, indirect, consequential or incidental damages including but not limited to lost or damaged property, lost profits or savings or damages for disappointment. The Tour Operator may arrange for the hot air ballooning to be performed under a ‘code-sharing’ arrangement, i.e. it may subcontract another ballooning company to provide you with your flight. In such instances, The Tour Operator accepts no liability in connection with such services or for any loss, injury, or damage to or in respect of any person or property. The Tour Operator reserves the right to alter contents of products and location when deemed necessary. The Tour Operator does however warrant providing services of equal nature and value. 3. Alteration and Cancellation of a Booking In the unfortunate event you should have to alter/cancel your booking, certain fees & conditions apply: If you wish to ALTER your flight booking: If you wish to CANCEL& receive a refund: Within 48 hours prior to a weekday flight, no changes are permitted. Between 48 hours and 7 days prior to a weekday flight - a $50 per person rebooking fee will be charged; your flight will need to be re-scheduled on a weekday flight only, excluding public holidays. 7 days or more prior to a weekday flight – a $25 per person rebooking fee will be charged. You will lose the full cost of your flight if you fail to show up for your flight. You may send someone else in your place if you wish – please let us know the name of the replacement person before the flight. You cannot receive a refund on any trips booked using a gift certificate. (See Section 4) NB: Separate cancellation and alteration provisions apply to large groups and customised events. These are specified on the group booking documentation supplied. The Tour Operator reserves the right to amend these fees and notice periods. When special circumstances arise, some of these Terms and Conditions may be superseded by those published on your booking confirmation documentation. 4. Gift Certificates Gift certificates are valid only when fully paid by the purchaser or distributor. Gift Certificates cannot be redeemed for cash or refunded in part or full. Certificates are transferable to other individuals and are valid only for the period indicated thereon. Once the certificate has been redeemed (i.e. the trip date has been booked) all other terms relating to Alteration and Cancellation (see Section 3) apply, however the value remains non-refundable. Should you need to extend the validity of your gift certificate beyond the normal 12 months, reinstatement fees apply: $50 – 6 month extension; $100 - 12 month extension. 5. Weather, Mechanical, Staffing Other Safety ConditionsHot air ballooning relies on suitable weather conditions in order to proceed safely. Information on specific weather considerations are provided for at the time of making the booking. Additionally, flights may be dependant on mechanical performance or staffing availability. When conditions are deemed by The Tour Operator to be unsuitable or unsafe to proceed, then trips may not go ahead on the scheduled date. Similarly a trip may be postponed due to less than minimum numbers being achieved. Our Melbourne flights may not always fly over the central business district (CBD/city area). Whilst our pilots will endeavour to fly as close to the CBD as possible, our flight path is determined by the most up to date meteorological conditions to ensure the safest possible flight for all concerned. In the unfortunate event that a Service must be delayed, rescheduled or cancelled due to any of the above factors, The Tour Operator will hold payment in credit and offer alternative booking dates. Any request for refund will be treated as per cancellation terms listed in Section 3 above. The Tour Operator will not accept any liability for travel, accommodation, inconvenience or other costs incurred or lost through such cancellation. International, interstate and country visitors should factor the possibility of short notice cancellation. 5. Rebooking Your Flight If your flight has been cancelled due to inclement weather conditions, please contact our office as soon as possible to rebook. Payment received for your flight will be held in credit and applied to the rebooking. Rebooking must be done within 12 months of the first cancelled flight date. There will be no refunds for bookings held on our system for longer than 6 months. 6. Discounted bookings Any discounts or special offers are only available on the full recommended retail price and are not valid in conjunction with any pre-existing discounts or seasonal specials. Any bookings made using a discount or special offer are non-refundable. Bookings are transferable to other individuals and are valid only for the period indicated thereon. Should you need to extend the validity of your booking beyond the normal 12 months, reinstatement fees apply: $50 - 6 month extension; $100 - 12 month extension. 8. Your Responsibility (a) It is your responsibility to ensure you have received booking confirmation details of your flight; please notify the The Tour Operator office immediately and prior to your flight date if you do not have this information. You are also required to follow the check-in procedure outlined in the confirmation letter the evening before your flight. If you do not contact the duty pilot as required between 6.30 and 7.00 p.m., The Tour Operator cannot be held liable for the consequences of not checking in with your pilot and receiving the latest instructions. (b) In the interests of safety, you undertake to follow the advice of the pilot and ground crew, comply with any local codes of conduct and act sensibly and prudently at all times. You also agree to indemnify The Tour Operator, its owners, officers and employees for all losses and/or damage arising from any act or default on your part or the part of a member of your party. Under no circumstances at any time during supply of the Services should you or a member of your party be under the influence of drugs or alcohol, nor should you take medication that could affect or impair your judgment at this time. (c) Check with your medical practitioner if you have a pre-existing medical condition that may be affected by the physical nature of hot air ballooning. You agree to indemnify The Tour Operator, its owners, officers and employees against any incident related to your health occurring during or after supply of the Services. (d) Personal belongings taken on board are at your own risk. (e) Ballooning is an outdoor adventure activity, and The Tour Operator cannot be held liable for damage to any clothing.

48 hours notice for a full refund. 24 hours notice for half payment refund. Less then 24 hours notice full payment will be taken.

Thunder Jet Boating:

All tickets are non-refundable and 24 hours notice required for cancellations.

Captain Cook Cruises (WA):

Cancellation or Changing Passenger Numbers. Cancellations received with more than 72hrs notice prior to tour departure may receive a refund. Cancellations within 72hrs of departure no refund will be issued. IN ALL CASES NO REFUNDS WILL BE GIVEN FOR 'NO SHOWS' All postponed cruises are treated as cancellations.

Kangaroo Island Adventure Tours:

Cancellation of a booking, or part thereof will incur the following fees: · More than 30 days before departure - $50 per person · Between 7 & 30 days before departure - $50 per person or 50% of total cost whichever is greater · Less than 7 days before departure - $50 per person or 80% of total cost whichever is greater · Within 24 hours of departure - 100% of total cost No refunds will be made for services not availed once travel has commenced. All refund claims must be made in writing. Cancellation Policy: Individual “Cruise like a local” bookings: Cancellations made more than 72 hours before travel (as logged in the Operator's system audit) may be made without penalty and a full refund will be given to the Customer. Cancellations made less than 72 hours before travel will attract a 100% cancellation fee and no refund at the Operator's discretion. The Operator has the right to retain all deposits received up to the amount of the cancellation fee and invoices will be issued for any further amounts outstanding. Groups or Exclusive Charters (12 paxs or more): Cancellations made more than 30 clear working days before travel (as logged in the Operator's system audit) may be made without penalty and a full refund will be given to the Customer. Cancellations made less than 30 clear working days before travel will attract a 50% cancellation fee. The Operator has the right to retain all deposits received up to the amount of the cancellation fee and invoices will be issued for any further amounts outstanding. Weather Cancellations: Cancellations made by the Operator due to inclement weather will entitle the Customer to a full refund of the Fare Price. Other Cancellations: Cancellations may be made at the Operators discretion due to mechanical breakdowns which may result in the vessel being unable to operate. If this occurs the Customer will receive a full refund of the Fare Price. Fail to Board: It is the Passenger's responsibility to ensure that they arrive on time for the departure of the vessel. Failure to do so will mean that the Passenger forfeits the full fare price to the Operator. Safety Requirements for Travel: 1. Disabled Passengers: The Operator recommends that disabled persons seek medical advice before participating. Disabled Passengers cruising aboard Calypso do so at their own risk and the Operator accepts no liability for any damage or injury caused. 2. Pregnant Persons: Pregnant persons cruising with Calypso do so at their own risk and the Operator accepts no liability for any damage or injury caused. 3. Intoxicated Persons: The Operator does not condone excessive drinking and no intoxicated person will be allowed to embark the vessel named Calypso. Minimum Age Requirement: There are no minimum age requirements for children to board Calypso. Children are the responsibility of their parents at all times. The Skipper and other crew members are not responsible for their care or safety. Life jackets are available on board for children and adults alike. Adult prices will apply from age 13 upwards. Times & Duration: May vary slightly at the skipper's discretion and depending on sea and weather conditions. The 'Cruise like a local' tour commences at 12.30pm and concludes at 4.30pm. Groups and exclusive charter embarkment and disembarkment times are arranged at the time of booking. Passengers are required to be at the pick up location 15 minutes prior to nominated departure. Days of Operation: The 'Cruise like a local' tour operates daily from 1st September to 1st June (inc), 12.30pm, returning 4.30pm. Minimum Numbers: 'Cruise like a local' departs with a minimum of two passengers and will cater up to 12 people. If you have numbers that exceed this, you will need to make a private booking.
